Kite and its licensors retain all right, title, and interest in and to the Software, including all intellectual property rights. No rights are granted by implication, estoppel, or otherwise. "Kite" and associated names, logos, and marks are trademarks of Kite, and this License does not grant any right to use them. 4. Third-Party Components The Software may include or depend on third-party components. Those components are governed by their respective license terms, and this License does not restrict rights granted under those terms. 5. Kite Services Use of the Kite Services may be subject to separate terms and fees. This License does not grant access to the Kite Services or obligate Kite to provide support, maintenance, updates, or continued availability of the Software or the Kite Services. Feedback If you voluntarily provide ideas, suggestions, or feedback about the Software or the Kite Services, you grant Kite a worldwide, perpetual, irrevocable, royalty-free right to use and incorporate that feedback without restriction or obligation. 7. Term and Termination This License remains effective until terminated. It terminates automatically if you breach any of its terms. Upon termination, you must stop using and delete all copies of the Software under your control. Sections 2 through 11 survive termination to the extent necessary to give them effect. 8. Limitation of Liability TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, KITE AND ITS AFFILIATES, LICENSORS, AND SUPPLIERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR BUSINESS OPPORTUNITY, ARISING OUT OF OR RELATED TO THE SOFTWARE OR THIS LICENSE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. Governing Law and Venue This License is governed by the laws of the Federative Republic of Brazil, without regard to conflict-of-law principles. Subject to any venue required by applicable law, the courts located in Natal, State of Rio Grande do Norte, Brazil, have exclusive jurisdiction over disputes arising out of or related to this License. 11. General If any provision of this License is held unenforceable, it will be enforced to the maximum extent permitted and the remaining provisions will remain in effect. A failure to enforce a provision is not a waiver. You may not assign or transfer this License without Kite's prior written consent. Kite may assign this License in connection with a merger, reorganization, sale of assets, or by operation of law. This License is the entire agreement regarding the Software and supersedes prior or contemporaneous agreements on that subject, except for a separate written agreement signed by Kite that expressly overrides it.
