Official Publish Date: January 15, 2026 This End User License Agreement ("Agreement") is a legal contract between you ("User") and Rohit Miryala ("Author") for the use of the software package Miryala Node.js Express Builder (the "Software"). By installing, accessing, or using the Software, you agree to be bound by the terms of this Agreement. 1. Grant of License The Author grants the User a non-exclusive, non-transferable, limited license to use the Software for personal or commercial projects solely in its compiled/distributed form as published on npm. 2. Permitted Uses The User may: - Use the Software to generate unlimited projects for personal or commercial purposes - Deploy generated projects to any hosting platform - Modify the generated project code (not the CLI tool itself) - Distribute applications built using the generated project structure 3. Restrictions The User may NOT, under any circumstances: - Copy, reproduce, modify, or reverse-engineer the source code of the CLI tool itself - Redistribute, republish, sell, or sublicense the Software (CLI tool) in any form, whether original or modified - Claim authorship, ownership, or authorship rights of the Software - Remove or alter any copyright notices, trademarks, or proprietary markings from the Software - Use the Software to create competing CLI tools or project generators - Extract, repackage, or redistribute the template files as a separate product 4. Acceptable Use and Fair Usage Policy The User agrees to use the Software and generated projects in accordance with all applicable laws and regulations. The User shall NOT: - Use the Software or generated projects for any illegal, unlawful, or criminal activities - Develop applications that facilitate fraud, theft, hacking, or unauthorized access to systems - Create projects that distribute malware, viruses, ransomware, or other malicious software - Build applications that violate privacy laws, data protection regulations (GDPR, CCPA, etc.), or user privacy rights - Generate projects for phishing, spam, or unsolicited communications - Develop applications that promote hate speech, violence, terrorism, or discrimination - Create systems that infringe upon intellectual property rights of others - Build applications for cryptocurrency mining without user consent - Develop projects that exploit vulnerabilities in other systems or networks - Use the Software to create applications that violate export control laws or sanctions - Generate projects for activities prohibited by international law or human rights violations The Author reserves the right to: - Revoke the license of any User found to be using the Software for prohibited purposes - Report illegal activities to appropriate law enforcement authorities - Cooperate with legal investigations related to misuse of the Software The User acknowledges that they are solely responsible for: - Ensuring their use of the Software complies with all applicable laws - The content, functionality, and purpose of applications built using generated projects - Any legal consequences arising from misuse of the Software or generated projects 5. Generated Projects Projects generated by the Software are owned by the User who generated them. The User has full rights to: - Modify, distribute, and commercialize the generated project code - Use the generated code in any application or service - Share or sell applications built from the generated projects However, the User must not: - Extract the generation logic or templates to create derivative CLI tools - Claim that the generated project structure is their original creation without attribution - Use generated projects for any purposes prohibited under Section 4 (Acceptable Use and Fair Usage Policy) 6. Attribution While not required, the Author appreciates attribution in projects generated by the Software. Suggested attribution: "Project scaffolded using Miryala Node.js Express Builder by Rohit Miryala" 7. Collaboration and Contribution Developers who wish to contribute, modify, or extend the Software must contact the Author for explicit written permission. Only authorized collaborators may make changes to the Software codebase. Updates and Maintenance The Author reserves the right to: - Release updates, patches, and new versions of the Software - Modify the terms of this Agreement with notice to users - Discontinue support or maintenance at any time Users are encouraged to keep the Software updated to the latest version. 9. Data Collection and Privacy The Software does not collect, transmit, or store any personal data or project information. All project generation occurs locally on the User's machine. 10. Third-Party Dependencies The Software and generated projects may include third-party open-source libraries and dependencies. These dependencies are subject to their own licenses and terms. The User is responsible for complying with all third-party license requirements. 11. Disclaimer of Warranty The Software is provided "AS IS" without any warranty of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. The Author does not warrant that: - The Software will meet your requirements - The Software will be uninterrupted, timely, secure, or error-free - The results obtained from using the Software will be accurate or reliable - Any errors in the Software will be corrected 12. Limitation of Liability In no event shall the Author be liable for any damages (direct, indirect, incidental, special, consequential, or punitive) arising from the use or inability to use the Software, including but not limited to: - Loss of profits, data, or business opportunities - Damage to computer systems or data - Cost of substitute goods or services This limitation applies even if the Author has been advised of the possibility of such damages. 13. Intellectual Property All intellectual property rights, including copyrights, trademarks, and patents, in the Software remain the exclusive property of the Author. This Agreement does not grant any rights to the source code of the CLI tool, other than the compiled/distributed form provided on npm. 14. Indemnification The User agrees to indemnify, defend, and hold harmless the Author from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from: - The User's use or misuse of the Software - Violation of this Agreement - Infringement of any third-party rights 15. Governing Law This Agreement shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law provisions. Any disputes arising under this Agreement shall be subject to the exclusive jurisdiction of the courts in Hyderabad, India. 16. Termination This Agreement is effective until terminated. The Agreement will terminate automatically if the User fails to comply with any term herein. Upon termination: - The User must cease all use of the Software - The User must destroy all copies of the Software in their possession - Generated projects may continue to be used and maintained - The User's license to use the Software is revoked 17. Severability If any provision of this Agreement is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect. 18. Entire Agreement This Agreement constitutes the entire agreement between the User and the Author regarding the Software and supersedes all prior agreements, understandings, and communications. 19.
